Betnacional Ordered by Brazilian Court to Halt Use of Aviator Brand

A Brazilian court has ordered Betnacional, operated by NSX Brasil S.A., to immediately cease using the “AVIATOR” name and its associated visual elements. This legal action follows SPRIBE’s claim that the game was being offered without proper authorization.

The court granted an injunction to prevent NSX Brasil S.A. from using the “AVIATOR” brand, including any visual, graphical, or audiovisual elements related to SPRIBE’s product. The ruling is in effect until further notice or a final decision on the appeal, with daily fines imposed for non-compliance.

The court’s decision was largely influenced by SPRIBE’s ownership of the “AVIATOR” trademark, registered with Brazil’s National Institute of Industrial Property, which grants exclusive rights to use the mark within Brazil. The dispute centers around Betnacional’s offering of a game named “Aviator,” provided by Aviator Studio since 2025, which SPRIBE claims is an unauthorized reproduction of its original AVIATOR crash game, developed in late 2018 and launched globally.

Betnacional, a prominent sports betting brand in Brazil operated by NSX Brasil S.A., recently became part of Flutter Entertainment Plc after Flutter acquired a majority stake in the NSX Group. Although Betnacional had been an authorized licensee since 2022, SPRIBE emphasized that it cannot tolerate breaches of its intellectual property rights and is committed to defending its assets across multiple jurisdictions.
